These Terms and Conditions of Sale govern all purchases made through Catopaks.com. By placing an order, the customer agrees to be bound by these terms. The contract between the customer and Catopaks.com is governed by Spanish law, including the Código Civil, the Real Decreto Legislativo 1/2007, Ley General para la Defensa de los Consumidores y Usuarios, and the Ley 34/2002 de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI CE). EU consumer protection and ecommerce rules under Directive 2011/83/EU on Consumer Rights, Directive 2000/31/EC on Electronic Commerce, and Directive 93/13/EEC on Unfair Terms in Consumer Contracts also apply.

1. Business Identity and Scope

Catopaks.com is operated by Grupo Cato 2009 SL, acting as a seller and distributor of marine accessories, electrical components, terminal connectors, coatings, Coppercoat, and related products. These Terms apply to all sales within Spain and the European Union, in accordance with Directive 2011/83/EU regarding distance selling and consumer rights.

2. Product Information

All products are described with reasonable accuracy, including images, specifications, and descriptions. Minor variations that do not affect the essential characteristics are allowed under Directive 2019/771/EU on the sale of goods. Catopaks.com reserves the right to correct errors or update product information at any time.

In cases of clear pricing errors, Catopaks.com may cancel the order and issue a full refund, in line with Código Civil provisions on error affecting contract consent.

3. Prices and Taxes

All prices include Spanish VAT, as required by Ley General Tributaria. Additional taxes, duties, or charges may apply for certain destinations and are disclosed at checkout. Prices are binding only at the time the order is confirmed, according to LSSI CE and Directive 2011/83/EU, which require transparent pricing for consumers.

4. Payment Methods and Contract Formation

Orders are confirmed upon successful payment via Stripe (credit/debit cards), PayPal, bank transfer, or Woopayments. Customers may also complete guest checkout.

The contract is formed at the point of confirmation email, as required by LSSI CE and Directive 2000/31/EC on electronic commerce. Customers are responsible for maintaining the confidentiality of any account credentials.

5. Order Availability and Cancellation

Catopaks.com processes orders in the sequence they are received. If a product is unavailable after purchase due to stock issues, the company will issue a full refund, in compliance with Real Decreto Legislativo 1/2007 consumer protection rules.

Customers may cancel an order before preparation for shipment. Once the order has been prepared for shipment, cancellation is not permitted, in line with Directive 2011/83/EU on the right of withdrawal.

6. Shipping and Delivery

Delivery is carried out via NACEX or equivalent carriers. Estimated delivery times are 24–72 hours within Spain Peninsula and 3–5 days to the Balearic Islands. Delivery times are estimates only, and Catopaks.com is not liable for delays caused by carriers, weather, or other external circumstances, consistent with Directive 2011/83/EU and Regulation (EU) 2018/644 on parcel delivery.

7. Right of Withdrawal and Returns

In accordance with Directive 2011/83/EU and Real Decreto Legislativo 1/2007, consumers have a 14-day period from delivery to exercise the right of withdrawal. Return shipping costs are borne by the customer.

Return Conditions:

  • Products must be unused and in original packaging
  • All accessories must be included
  • Customer must provide photos for approval

Excluded Products:

  • Coppercoat and other chemical coatings requiring special handling
    This exclusion is permitted under Directive 2011/83/EU, which allows exceptions for goods that deteriorate quickly or are custom mixed.

Refunds are issued through the original payment method.

8. Warranty

Products sold comply with the three-year legal guarantee under Spanish law, as established in Real Decreto Legislativo 1/2007 and Directive 2019/771/EU. Warranty claims cover manufacturing defects only. Catopaks.com is not responsible for damage caused by improper installation, incorrect preparation of surfaces, lack of maintenance, misuse, or exposure to conditions outside the intended marine use guidelines, in accordance with the limitation clauses allowed under Código Civil and EU consumer law.

9. Customer Responsibility for Marine Products

For specialized products like Coppercoat, customers are responsible for correct surface preparation, mixing, application, and environmental conditions. Misuse, improper application, or failure to follow instructions voids any warranty, consistent with Directive 2011/83/EU exceptions.

10. Limitation of Liability

To the maximum extent allowed by Spanish and EU law, Catopaks.com excludes liability for:

  • Indirect or consequential damages
  • Loss of profits or business
  • Delays caused by carriers, weather, or force majeure
  • Improper installation, shipyard mistakes, or misuse
  • Marine corrosion or environmental damage

Liability is limited to the purchase price of the affected product. Consumer rights under Real Decreto Legislativo 1/2007 and Directive 2011/83/EU are preserved.

11. Digital Invoices

Invoices are issued exclusively by email, in compliance with LSSI CE and GDPR requirements. No printed invoices are provided.

12. Data Protection

Customer data is collected and processed in accordance with GDPR (EU 2016/679) and LOPDGDD (Spain 3/2018). Customers have the right to access, rectify, delete, and oppose processing of personal data. Details are provided in the Catopaks.com Privacy Policy.

13. Governing Law and Jurisdiction

These Terms are governed by Spanish law, including consumer protection provisions of Real Decreto Legislativo 1/2007 and civil contract law under Código Civil. Disputes will be submitted to the courts of Alicante, Spain, except where mandatory consumer jurisdiction allows the customer to sue in their local court, in compliance with Directive 2011/83/EU.

14. Language

If these Terms are translated into another language, the English version prevails in case of any conflict, in accordance with Directive 2011/83/EU.
